Welcome to staygold. These Terms of Service ("Terms") govern your use of the staygold mobile application (the "Service") operated by Staygold ("we", "our", or "us"). By using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.

3. Account Registration

To access certain features, you may need to create an account. You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activity that occurs under your account

You may sign in using Apple Sign In. You may delete your account at any time through the app settings.

4. The Service

staygold is an AI-guided gratitude journaling application. The Service uses artificial intelligence to facilitate reflective conversations and help you cultivate a gratitude practice. Your messages are sent to third-party AI providers (such as OpenAI or Anthropic) to generate responses.

The Service is a journaling tool, not a therapist or doctor. AI-generated responses are for reflective and informational purposes only and do not constitute medical, psychological, or professional advice. If you are in crisis, please reach out to the 988 Suicide & Crisis Lifeline.

5. User Content

You retain ownership of the content you create within the Service, including journal entries, messages, and photos. By using the Service, you grant us a limited license to store and process your content solely to provide and improve the Service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Use automated means to access the Service without our permission
• Upload content that is harmful, abusive, or violates the rights of others
• Impersonate any person or entity

7. Intellectual Property

The Service — including its design, features, code, and branding — is owned by Staygold and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

8. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. You may delete your account at any time through the app settings, which will permanently remove your account and associated data as described in our Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We make no guarantees about the accuracy or appropriateness of AI-generated content.

10. Limitation of Liability

To the fullest extent permitted by law, Staygold shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
